For Full Season class enrollment, we do NOT offer makeups, credits, or refunds for any missed dates, no-shows, or prorate for advanced notice of absences.  Please be sure of your schedule!

For non-Full Season class & private lesson enrollments (i.e. single classes/lessons, 10-packs), cancellation of scheduled classes are allowed up to 24 HOURS before the class for a store credit. No-shows and/or no notification thereafter will be forfeit any eligible credit.

Proper on-court etiquette is expected by all patrons of LA Tennis Centers &  LA City Parks. We reserve the right to refuse service.

Assumption of Risk, Waiver of Liability, and Indemnification Agreement

TNT Doubles LLC (dba Palisades Tennis Center, Westwood Tennis Center, and Cheviot Hills Tennis Center) is a tennis-related business (hereafter referred to as TNT) whose goals are 1) to provide youth and adults the opportunity to learn and/or improve their tennis skills and 2) to provide wholesome recreational opportunities through recreational tennis play and competitive tennis play. TNT provides private and group lessons for adults as well as adult clinics called “Live Ball” (a dynamic, non-stop tennis doubles activity). Youth can sign up for private lessons or group clinics (which are divided into three categories based on skill level). Additionally, TNT offers summer tennis camps for minor participants. This agreement applies to 1) personal injury (including death) from incidents or illnesses arising from my participation (or that of my minor participant) in TNT activities (including, but not limited to, instruction, individual or group activity, competitions, training, practice, classes, special events, camps, observation, use of facilities or equipment utilized for TNT activities, and all premises including sidewalks and parking lots); and to 2) any and all claims resulting from the damage to, loss of, or theft of property. The above are collectively referred to herein as the TNT Activities. In exchange for the opportunity to participate in the TNT Activities and/or enter the TNT premises, I (hereafter “PARTICIPANT”) agree to all of the following:

 

Things You Need to Know:

TNT Activities have many benefits for the PARTICIPANT. They can: provide an enjoyable recreational activity, contribute to fitness, increase one’s confidence, help control body weight, and increase one’s skill in a lifetime sports activity. However, TNT Activities do involve vigorous physical activity, including, but not limited to, jumping, landing, running, swinging a racket, following and striking a fast moving ball, and other skills. TNT feels that it is very important that the PARTICIPANT/PARENT (which refers to either an ADULT Participant, OR a MINOR Participant and his/her PARENTS/GUARDIANS) understands that all physical activities include some inherent risks of injury; these inherent risks cannot be eliminated regardless of the care taken to avoid injuries. Some examples of these inherent activity risks are slip & falls; trips on uneven pavement; landing awkwardly from a leap; colliding with other participants, equipment, or with fixed objects such as fences, posts, and nets; being struck by a ball or a racket; stepping on a ball (many balls are on the court during Live Ball); unexpected equipment failure; and over-exertion. Examples of Environmental risks are extreme temperatures; sudden changes in weather conditions; high winds; wet or slick courts; and lightning. Examples of Participant-related risks are erratic co-participant behavior; carelessness of co-participant in partner activities; participant or co-participant errors of judgment; and carelessness or lack of attention on the part of the participant or co-participant. TNT Leadership-related risks include, but are not limited to, supervisory or judgment error (e.g., supervisor misjudging the capacity of the participant to perform a task; misjudging participant’s grasp of a skill; judgment error in matching partners or opponents; failure to spot a correctable hazard during facility inspection; and momentary distraction or inattention).

TNT feels it is important that the PARTICIPANT/PARENT understands that three kinds of injuries can occur: 1) common minor bodily injuries such as scratches, bruises, cuts, muscle pulls, muscle soreness, and sprains; 2) occasional major bodily injuries, including, but not limited to, eye injuries (e.g., loss of sight in an eye), ankle, knee, and other joint injuries (e.g., tendon, ligament), injuries to feet, legs, hands, arms, chest, back, teeth, neck, and head (including concussions); and 3) rare catastrophic bodily injuries including, but not limited to, injuries resulting in permanent disability, paralysis, heart attacks, and death.

 

Assumption of Inherent Risks:

I, the PARTICIPANT/PARENT, have read the above paragraphs and know that TNT Activities contain significant inherent risks which vary with the activity. I understand the demands of those activities relative to my physical condition and skill level (or that of my minor participant), and I appreciate the types of injuries that may occur as a result of TNT Activities and their potential impact on my well-being and lifestyle (or that of my minor participant). I hereby assert that my participation (or that of my minor participant) is voluntary and that I knowingly assume ANY AND ALL RISKS, including all inherent risks, even those caused by or resulting from any negligence of TNT.

 

Waiver of Liability for Ordinary Negligence:

In consideration of permission to participate in the TNT Activities and services, today and on all future dates, I, the PARTICIPANT/PARENT, on behalf of myself, my spouse, my heirs, personal representatives, and assigns [hereafter referred to as Releasing Parties] do hereby release, waive, discharge, and covenant not to sue TNT, its owner, directors, officers, instructors, employees, volunteers, co-participants, independent contractors, equipment providers, agents, and owners of facilities (City of Los Angeles) utilized for TNT Activities [hereafter referred to as Protected Parties] from liability from any and all claims arising from the ordinary negligence of TNT or the Protected Parties.

 

Indemnification Agreement:

I, the PARTICIPANT/PARENT, also agree to hold harmless, defend, and indemnify TNT and Protected Parties (that is, defend and pay any judgments and costs, including investigation costs, attorney’s fees, and related expenses) from any and all claims of Releasing Parties or others acting on my behalf (or on behalf of my minor participant), arising from participation in TNT Activities, (including those arising from the inherent risks of the activity or the ordinary negligence of Protected Parties). I further agree to hold harmless, defend, and indemnify TNT and Protected Parties against any and all claims of co-participants, rescuers, and others arising from the conduct of the PARTICIPANT while on the premises utilized for TNT activities.

 

Clarifying Clauses:

• I, the PARTICIPANT/PARENT, confirm that this agreement 1) supersedes any and all previous oral or written promises or agreements; 2) is the entire agreement between me and TNT; and 3) may not be amended by statements by TNT employees.
• I further expressly agree that 1) this document is intended to be as broad and inclusive as is permitted by the laws of the State of California and 2) that if any portion thereof is held invalid, the balance shall continue in full legal force and effect.
• I also understand that if any legal action is brought, the appropriate state trial court for Los Angeles County, California or the United States District Court for the Central District of California has the sole and exclusive jurisdiction and that only the substantive laws of the State of California shall apply.

Rules and Actions for Participant Safety

Health: I, the PARTICIPANT/PARENT, …

• Acknowledge that TNT urges participants to get medical clearance prior to participation.
• Affirm that participant has no health problems that would make participation in TNT Activities unwise.
• Authorize TNT to secure emergency medical care or transportation (i.e., EMS) when deemed necessary by TNT; and I agree to assume all costs of emergency medical care and transportation.
• Acknowledge that it is the participant’s duty to inform staff and cease exercise immediately in the event of unusual discomfort (e.g., faintness, shortness of breath, high anxiety, chest pains).

SAFETY: I, the PARTICIPANT/PARENT, …

• Understand that participant has the responsibility to not participate in an activity participant feels is too risky.
• Affirm participant has a duty to immediately correct or report any unsafe action or dangerous condition.

Injury: I, the PARTICIPANT/PARENT, …

• Affirm that participant agrees to report all injuries, minor or serious ones, to TNT before leaving the tennis facility.

Conduct: I, the PARTICIPANT/PARENT, …

• Agree to abide by all policies, rules, and regulations of TNT; further, I understand TNT may terminate my participation at any time in the event my actions could be harmful to myself or others.

Photo/Video Release I, the PARTICIPANT/PARENT, …

• Authorize the use of photos or videos of participant in print or electronic marketing, advertising, and web content.

Acknowledgement of Understanding:

I, the Adult PARTICIPANT or the Parent/Legal Guardian of the minor child participating in TNT activities, have read the TNT Doubles Assumption of Risk, Waiver of Liability, and Indemnification Agreement and understand that I am giving up substantial rights, including my right to sue for damages in the event of death, injury, or loss. I agree to be bound by this agreement on behalf of myself, my spouse, the minor child, and any party filing on behalf of the minor child. I understand that I am releasing both my right (and the right of my minor child, where applicable) to sue for damages in the event of injury, death, or financial loss. I acknowledge that I am voluntarily signing this agreement, and intend my signature to be a complete release of all liability, including that due to the INHERENT RISKS of TNT Activities or the ORDINARY NEGLIGENCE of the Protected Parties, to the greatest extent allowed by laws of the State of California.  Where applicable, by signing on behalf of the minor child, I, the Parent/Guardian of the minor child, assert that I have explained the inherent risks of TNT Activities to my minor child and that the minor understands this Agreement.
